Rules of the UNO™ Contest (free, no purchase necessary) Article 1: Object The company GAMELOFT S.A., domiciled at 81, rue Réaumur, 75002 Paris, registered with the Paris RCS under the number 429 338 130 (hereinafter referred to as GAMELOFT), is organizing a contest, free and with no purchase necessary, titled "UNO™ Contest" (the "Game"), available only to members of the social networking site Facebook. Participation in this contest involves accepting irrevocably and without reservations the present rules (the "Rules"), the laws of ethics in place on the Internet, as well as laws, regulations (notably fiscal) and other applicable texts regarding games in France. Non-compliance with the conditions of participation stated in the present Rules will cause the participation to be null. GAMELOFT cannot in any case be held responsible for the participation of a person domiciled in country other than those stated herein. Article 2: Conditions of Participation The "UNO™ Contest" game, free and with no purchase necessary, is open to any person residing in France, the United Kingdom, Germany, Italy and Spain, regardless of nationality, who is a member of the social networking site Facebook (hereinafter referred to as the "Participant"). Persons with a direct legal link to GAMELOFT, or who have participated in the elaboration of this contest, as well as members of their families, are excluded and can neither play nor benefit, in any regard or under any form whatsoever, from the prizes to be won. Article 3: Duration and Availability The Game will take place from November 11, 2009 to November 25, 2009 inclusively. The Game will be available only to members of the social networking site Facebook. However, GAMELOFT reserves the right to extend, suspend or interrupt the current contest at any moment and without prior notice if the circumstances require it. GAMELOFT cannot be held responsible for this as a result. Article 4: Terms of Registration and Participation Participation in this Game is free and without purchase necessary in the conditions defined herein. All participants can request a refund of the cost of their participation in the contest in the conditions described in Article 10 below. The objective for all Participants is to become a Fan of Gameloft’s page on Facebook by visiting www.facebook.com/gameloft and validating their participation in the contest by writing the message "I want to play UNO™ on the Nintendo Wii and DSi" on the wall of Gameloft's Facebook page (www.facebook.com/gameloft). Posting this message on the wall of Gameloft's Facebook page validates participation in the random drawing. Each Participant can only participate in the Game once and can only win once throughout the duration of the contest. Article 5: Appointing the Winners At the end of the contest, a random drawing will be performed among the Participants who posted the above message on the wall of the Facebook page defined above. 31 Participants will be drawn at random and will be appointed winners of one of the 31 prizes in the game. The randomly selected Participant in 1st place will be awarded Prize 1 as defined below. Participants randomly drawn from 2nd to 31st places will be awarded Prizes 2 to 31 respectively as defined below. Normally, prizes should be sent to the winners via postal service within 2 (two) months from the end date of the contest. However, this delay is purely by way of example, and GAMELOFT cannot be held responsible as a result in case the aforementioned delay has passed. Only one prize per Household will be awarded throughout the duration of the Game. The prizes will be sent to the postal address provided by the Participant. Prizes awarded to winners cannot be contested, neither for a remittance of an exchange value in money, total or partial, nor for an exchange or replacement for any cause whatsoever. Prizes are non-negotiable. Consequently, no claims will be acknowledged. GAMELOFT denies all responsibility in case of any incident that may occur to the winner during the use or enjoyment of the prize awarded. In case a winner expressly waives their prize, the latter will be kept by GAMELOFT and may be used in a future operation, if the nature of the prize permits it. Prizes offered to winners are nominative and cannot be awarded to another person. Before remittance of their prize, each winner must fulfill the conditions defined in the Rules and confirm their identity. It is stated that if a minor wins one of the prizes offered in the Game, the prize will be awarded only upon the written approval of a person having parental authority. Absence of authorization will result in the loss of the prize, which will not be awarded again. In case a prize is returned to GAMELOFT or is not distributed, the winner loses the right to claim their prize, and GAMELOFT cannot be held responsible. GAMELOFT cannot be held responsible for any deterioration during transportation, theft or loss incurred during the delivery. GAMELOFT cannot be held responsible for any incidents or accidents that may occur during the use of the prizes. Upon simply participating in the contest, winners authorize GAMELOFT to reproduce and use their surname, name, address, mobile telephone number and e-mail address in any promotional operation or advertising and promotional event related to the current Game, without this use conferring upon the winners the right to payment or any advantage other than the remittance of the prize. Article 6: Description of the Prizes The prizes attributed to the Game are: Prize 1: A Nintendo DSi game console, with a commercial value of 159 euros per unit, all taxes included. Prizes 2 to 31: An UNO™ game for WiiWare, with a commercial value of 5 euros per unit, all taxes included. Article 7: Exclusions and Prosecution GAMELOFT can suspend and cancel the participation of one or more Participants in case suspicious and fraudulent behaviour is observed. GAMELOFT has the sole right to decide upon the exclusion or reintegration of Participants concerned regarding information in their possession. GAMELOFT reserves the right not to award prizes to fraudulent Participants and/or to prosecute the persons responsible for this fraud before the relevant jurisdictions. GAMELOFT can cancel the Game, in whole or in part, if it appears that fraud has occurred in any form whatsoever, notably in an electronic manner. Article 8: Nominative Information Concerning Participants Nominative information collected as part of the contest is treated in accordance with the law of January 6, 1978 "Loi Informatique et Liberté". All Participants in the contest have the right to access and rectify information that concerns them as per article 27 of this law. Participants are hereby informed that nominative information that concerns them can be the object of a possible communication to GAMELOFT's business partners and that they may object to this communication. Any request for access, rectification or objection must be sent to the following address: GAMELOFT S.A., 14 rue Auber, 75009 Paris, France. Article 9: Exclusion of Responsibility GAMELOFT cannot be held responsible in case of possible malfunction of the methods of participation in the contest. GAMELOFT denies any responsibility in case of failure or technical incident preventing the Game from proceeding and which may cause possible loss of points. GAMELOFT cannot be held responsible if, for reasons beyond their control, the Game is partially or completely modified, delayed or cancelled. Any exchange value of the prizes awarded cannot be offered in compensation. Article 10: Refund of the Participation Fee Web connection: Refunding the connection fees incurred to participate in the contest corresponding to web connection fees will be limited to 3 minutes of connection time, based on the cost of local communication according to France Telecom's rates in effect during the drafting of these Rules (0.16 euros per minute). Participants who do not pay connection fees related to the volume of their communications (users with an "unlimited" subscription, ADSL cable users, etc.) cannot obtain a refund. The request for a refund must be sent by mail postmarked within the month following the date of participation to the following address: GAMELOFT S.A., "UNO™ Contest" game, 14, rue Auber, 75009 Paris – France. The refund request fees will be reimbursed based on a simple letter of less than 20 grams stamped at economy rate. Article 11: Registration of the Rules The Rules are registered at SCP Gaultier-Mazure, Huissiers de justice associés, 51, rue Sainte Anne, 75002 Paris. They are sent free of charge by second-class mail to any persons who request it to: GAMELOFT S.A., "UNO™ Contest" game, 14, rue Auber, 75009 Paris – France. Article 12: Modification of the Rules GAMELOFT reserves the right to modify the Rules as needed, to take any decisions they believe useful for the application and interpretation of the Rules, on condition to inform the Participants. All modifications, substantial or not, to the Rules may be made during the Game proceedings, and will thus be made knowledge to Participants who must submit to them as addenda to the current Rules. Article 13: Litigation Any difficulty that may arise from the application or interpretation of the Rules or that may not be foreseen by the latter will be resolved by GAMELOFT. Any litigation will be submitted to the relevant tribunal in Paris.
